Debt RecoveryGETTING BACK YOUR PROPERTY - ASSURED SHORTHOLD TENANCIES

Broadly speaking possession proceedings fall into two categories:

  1. Your tenant has failed to pay their rent during the course of their Assured Shorthold Tenancy; or
  2. The Assured Shorthold Tenancy has come to an end and the tenant refuses to leave your property.
NON-PAYMENT OF RENT
  • As soon as the tenant is two months in arrears you are entitled to commence possession proceedings.  A Section 8 Notice needs to be served on the tenant.  We will issue and serve this Notice for £95 plus VAT.
  • In the event that the tenant does not respond to the Section 8 Notice possession proceedings are issued.  The cost for these proceedings are as follows:

    Court fee   £150
    Our fees    £475 plus VAT

    Provided that there is no defence to the proceedings this will be the total cost for dealing with the possession proceedings.  If a defence is received then we will take your instructions, advise you on the defence and let you know the likely costs involved in pursing the action.  Our possession proceedings will also include a claim for payment of the outstanding rent.
POSSESSION AT THE END OF AN ASSURED SHORTHOLD TENANCY
  • A Section 21 Notice should have been served on the tenant by you or your letting agent at the outset of the tenancy.  This Notice advises the tenant that possession will be required at the end of the term of the tenancy.  Provided that you have given such a valid notice then possession proceedings can be issued immediately.  If such a notice has not been given then we can issue a notice for you.  Our fee for issuing the Notice will be £95 plus VAT.

  • Possession proceedings are issued under a fast track scheme known as accelerated possession.

  • Provided that the paperwork is in order the Court will make a possession order.  The cost of issuing possession proceedings are as follows:

    Court fee   £150
    Our fee      £350 plus VAT

    Provided no defence is received to the claim this will be the total cost for dealing with the possession proceedings.  If the claim is defended then we will advise you immediately as to the merits of the defence and the cost involved in pursuing the action.  Please note that accelerated possession proceedings do not allow a claim to be made for rent arrears.  However, our debt collection department can undertake collection of these arrears often on a “no collection-no fee” basis.
TAKING BACK YOUR PROPERTY

Should the tenant fail to vacate the property once a possession order is obtained then we will instruct the bailiffs to obtain possession for you.  The costs are as follows:

Bailiffs fee   £90
Our fee       £95 plus VAT
